Welcome to Dcqikan.

These Terms of Service (“Terms”) govern your access to and use of www.dcqikan.com (the “Site”), including your purchase of products and use of services provided by Dcqikan (“Dcqikan,” “we,” “us,” or “our”).

By accessing the Site, creating an account, or submitting an order, you agree to these Terms. If you do not agree, please do not use the Site or place an order.

These Terms do not limit any consumer rights that cannot be waived or restricted under applicable law.

1. About Dcqikan

Dcqikan is an online fashion retailer offering products directly to customers through our Site.

Our business and Customer Support information is provided in the “Contact Us” section at the end of these Terms.

2. Eligibility

To place an order, you must be at least the age of legal majority in your jurisdiction or use the Site with the authorization and supervision of a parent or legal guardian.

By placing an order, you represent that you have the legal capacity and authority to enter into a binding agreement.

3. Acceptable Use of the Site

When using the Site, you agree that you will not:

• Use the Site for unlawful, fraudulent, or abusive purposes.
• Provide false, incomplete, or misleading account or order information.
• Use a payment method without authorization.
• Attempt to interfere with the Site’s security, availability, or operation.

4. Customer Accounts

If you create an account, you are responsible for maintaining accurate account information and protecting your login credentials.

Please notify us promptly if you believe your account has been accessed or used without authorization.

We may suspend or close an account when reasonably necessary for security, fraud prevention, legal compliance, or a material violation of these Terms.

5. Product Information

We make reasonable efforts to present accurate product descriptions, sizing, materials, colors, images, prices, and availability.

Actual product appearance may vary slightly because of factors such as:

• Device and screen settings
• Photography and lighting conditions
• Normal manufacturing variations
• Fabric characteristics and production batches

Measurements and sizing information are approximate unless otherwise stated. Customers should review the individual product description and our Size Guide before purchasing.

Minor variations that do not materially affect the product may not constitute a defect. Products that are materially different, damaged, defective, or incorrectly supplied will be handled according to our Return and Refund Policy and applicable law.

Product availability is not guaranteed until an order has been accepted.

6. Prices, Currency, Taxes, and Errors

Product prices are displayed in the currency identified on the Site or during checkout. Prices may change before an order is submitted but will not be changed after an order has been accepted, except where required to correct an agreed order modification or as otherwise permitted by law.

Applicable shipping charges, taxes, and other charges will be displayed or communicated during checkout where required.

For international orders, customs duties, import taxes, and related charges, if applicable, are handled as described in our Shipping Policy.

Although we make reasonable efforts to ensure pricing accuracy, obvious typographical, technical, or pricing errors may occasionally occur.

If an error affects a pending order, we will notify you and provide an appropriate option to confirm the order at the correct price or cancel the affected item or order.

If a paid order is canceled because of our error, the applicable amount will be refunded to the original payment method.

7. Orders and Order Acceptance

Submitting an order constitutes an offer to purchase the products shown in your order, subject to these Terms and our applicable store policies.

An order confirmation email acknowledges that we received your order. It does not necessarily mean that the order has been accepted or shipped.

An order is accepted when we send a shipping confirmation or otherwise expressly confirm that the order has been accepted.

We may review, limit, refuse, or cancel an order for reasons including:

• Product unavailability
• An obvious price, product, or inventory error
• Payment authorization failure
• Incomplete or inaccurate order information
• Suspected fraud or unauthorized payment activity
• Unusual order quantities or suspected unauthorized resale
• Shipping restrictions or legal requirements
• Security or risk-management concerns

When reasonably possible, we will notify you if an order is refused or canceled. If payment has already been collected for a canceled item or order, we will issue a refund to the original payment method.

8. Payment Terms

By submitting payment information, you represent that:

• You are authorized to use the selected payment method.
• The payment and billing information you provide is accurate and complete.
• You authorize the applicable charge for your order.

Payments are processed through Shopify and authorized third-party payment providers. Dcqikan does not directly store complete payment card numbers or card security codes on its own servers.

A payment provider may place a temporary authorization hold on your payment method. The timing for releasing an authorization or posting a refund may depend on your bank or payment provider.

9. Shipping and Delivery

Available shipping destinations, order processing times, estimated transit times, shipping charges, and tracking information are described in our Shipping Policy.

Please review the Shipping Policy before completing your purchase.

Delivery dates are estimates rather than guarantees unless we expressly state otherwise.

Delivery may be affected by factors including:

• Carrier operations and delays
• Shipping destination
• Severe weather
• Public holidays
• Customs processing
• Incorrect or incomplete address information
• Events beyond our reasonable control

We maintain a reasonable basis for the processing and shipping timeframes presented on our Site.

If we become unable to ship within the promised timeframe, we will provide notice and the options required by applicable law, which may include consenting to a revised shipping date or canceling the unshipped order for a refund.

Customers are responsible for providing a complete and accurate delivery address. If you notice an address error, contact us as soon as possible.

We cannot guarantee that an address can be changed after an order has entered fulfillment.

If a shipment is lost, damaged, or marked as delivered but cannot be located, please contact Customer Support promptly so that we can review the available tracking information and provide assistance consistent with our policies and applicable law.

10. Returns, Exchanges, and Refunds

Return eligibility, return timeframes, product condition requirements, exchanges, return shipping costs, damaged or incorrect products, and refund processing are governed by our Return and Refund Policy.

Customers must contact Customer Support and follow the applicable return instructions before sending a product back.

Nothing in these Terms or our Return and Refund Policy limits any return, refund, withdrawal, conformity, or warranty right that cannot legally be excluded in your jurisdiction.

11. Order Cancellation

Customers may request an order cancellation before the order has been shipped or otherwise entered a stage where cancellation is no longer reasonably possible.

We will make reasonable efforts to process eligible cancellation requests, but cancellation is not guaranteed after fulfillment has started.

If an order can no longer be canceled, customers may request a return after delivery in accordance with our Return and Refund Policy and any mandatory rights under applicable law.

12. Promotions and Discount Codes

Promotions, discount codes, and special offers may be subject to additional conditions, including eligibility, product exclusions, minimum purchase requirements, expiration dates, and usage limits.

Unless expressly stated otherwise, discount codes cannot be exchanged for cash and may not be combined.

We may refuse or cancel the unauthorized, fraudulent, or abusive use of a promotion.

Ending or changing a promotion will not affect an eligible order already accepted under the valid promotion, except where correction is legally permitted or required.

13. Reviews and Customer-Submitted Content

If the Site allows you to submit a review, photograph, comment, or other content, you must have the right to submit that content.

Customer-submitted content must not:

• Contain false or misleading claims.
• Infringe another person’s copyright, trademark, privacy, or other rights.
• Contain unlawful, abusive, threatening, or discriminatory material.
• Contain malicious code, spam, or unrelated promotional content.
• Disclose another person’s private information without authorization.

Reviews should reflect genuine customer experiences. We do not require reviews to be positive and will not remove a review merely because it expresses a negative opinion.

By submitting content, you grant Dcqikan a non-exclusive, worldwide, royalty-free license to host, reproduce, display, format, and use that content in connection with our Site, products, customer communications, and marketing, subject to applicable privacy and consumer protection laws.

We may moderate or remove content that violates these Terms, applicable law, platform requirements, or the rights and safety of others.

14. Intellectual Property

The Site and the text, graphics, logos, photographs, videos, layout, software, and other materials made available through it may be protected by copyright, trademark, and other intellectual property laws.

Dcqikan and the applicable licensors or rights holders retain their respective rights in this content. Product names, brand names, and trademarks belonging to third parties remain the property of their respective owners.

You may access and use the Site for personal, non-commercial shopping purposes.

You may not reproduce, distribute, modify, republish, sell, or commercially use protected Site content without permission from the applicable rights holder.

If you believe content on the Site infringes your intellectual property rights, please contact us at hello@dcqikan.com and include sufficient information to identify the work, the disputed content, and your authority to submit the request.

15. Third-Party Services and Links

We use third-party providers such as Shopify, payment processors, shipping carriers, analytics providers, advertising platforms, and Customer Support services to operate our store.

Those providers may process information according to their own terms and privacy notices.

Our use of service providers does not remove any responsibility that Dcqikan has to customers under applicable law.

The Site may also contain links to third-party websites that we do not control. We are not responsible for the independent content, availability, or practices of third-party websites.

A link does not necessarily constitute our endorsement of that third party.

16. Website Availability and Corrections

We work to provide a reliable and secure website, but we do not guarantee that the Site will always be uninterrupted, available, or completely error-free.

Access may be affected by:

• Scheduled maintenance
• Website updates
• Technical issues
• Internet interruptions
• Security concerns
• Events outside our reasonable control

We may correct errors, update information, or modify Site functionality when reasonably necessary.

Any correction affecting an accepted order will be handled in accordance with these Terms and applicable law.

17. Events Beyond Reasonable Control

Neither party will be responsible for delay or failure caused by events beyond its reasonable control, such as severe weather, natural disasters, carrier interruptions, labor disruptions, government action, widespread network failures, or public emergencies.

This section does not eliminate any obligation to provide notices, cancellation options, refunds, or other remedies required by applicable consumer law.

18. Disclaimer of Warranties

To the extent permitted by law, the Site is provided on an “as available” basis.

We do not guarantee that Site access will be uninterrupted, secure, or free from every technical error.

This disclaimer does not exclude any express product commitment or statutory warranty, conformity, refund, or consumer right that cannot legally be excluded.

Some jurisdictions do not permit certain warranty exclusions, so part or all of this section may not apply to you.

19. Limitation of Liability

To the maximum extent permitted by applicable law, Dcqikan will not be liable for indirect, incidental, special, punitive, or consequential damages arising from use of the Site or a product purchase when such damages were not reasonably foreseeable.

To the extent legally permitted, Dcqikan’s aggregate liability relating to a specific order will not exceed the amount paid for the product or order giving rise to the claim.

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability arising from fraud, willful misconduct, gross negligence, death or personal injury caused by negligence where applicable, or violation of non-waivable consumer rights.

This section does not limit our obligation to provide an applicable refund, replacement, or other remedy required by our published policies or by law.

20. Privacy

Our collection and handling of personal information is described in our Privacy Policy.

Where required, choices concerning non-essential cookies and targeted advertising are collected separately through our cookie banner or Your Privacy Choices page.

21. Electronic Communications

By placing an order or contacting us electronically, you consent to receive transaction-related communications electronically, including:

• Order confirmations
• Payment notices
• Shipping and tracking updates
• Cancellation or refund notices

Transactional communications are separate from marketing communications. Marketing messages remain subject to your consent and unsubscribe choices where required by law.

These Terms are governed by the laws of the State of South Carolina and applicable United States federal law, without regard to conflict-of-law principles.

This choice of law does not deprive consumers of mandatory protections provided by the laws of their usual place of residence where those protections apply.

If you have a concern, we encourage you to contact Customer Support so that we can attempt to resolve it.

Nothing in this section prevents either party from exercising rights or seeking remedies available under applicable law.

Any legal proceeding will be brought before a court with jurisdiction under applicable law.

24. General Terms

Our Privacy Policy, Shipping Policy, Return and Refund Policy, and Payment Terms are incorporated into these Terms by reference.

If a provision of these Terms is found to be unlawful or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will remain in effect.

A failure to enforce a provision of these Terms does not waive the right to enforce it later.

These Terms and the policies incorporated by reference constitute the agreement between you and Dcqikan concerning your use of the Site and applicable purchases, subject to any additional terms expressly presented for a specific product or service.
